Estas são as seguintes categorias de dados: nome do dispositivo, bem como nome e dados de contato do usuário, nome/descrição do cliente, bem como dados de análise.
Fazemos uma análise de dados, compostos por dados de clicks que geram durante o uso, por exemplo, arquivos em PDF, apresentações em PowerPoint ou tabelas de Excel, arquivos de vídeo ou áudio.
Nós fazemos o upload e administramos o conteúdo.
Exemplos de análise de dados que são processados: dados do dispositivo, documentos exibidos, slides ou páginas, duração da exibição, sequência dos slides, páginas, documentos, análise de páginas ("cliques").
A partir destes dados de análise são gerados relatórios, painéis, listas e resumos.
Não fazemos levantamento nem processamento de dados de posição e movimento (hora, posição etc.) no uso do aplicativo ARIS, o que significa que não podemos tirar conclusões sobre local de uso e/ou de permanência.

A Silhouette International AG e o Grupo Brodheim são ambos responsável pelo cumprimento das obrigações, especialmente da obrigação de informar os titulares dos dados sobre os respetivos direitos ao abrigo do Regulamento Geral sobre a Proteção de Dados (RGPD).

Encarregado da Proteção de Dados

A Silhouette International AG não indicou nenhum Encarregado da Proteção de Dados, não sendo tal necessário à luz do RGPD. O Encarregado da Proteção de Dados do Grupo Brodheim, nos termos do artigo 37.° do RGPD, é o Rodrigo Adão da Fonseca.

Finalidade

Os dados pessoais recolhidos serão tratados através da aplicação CRM-Software ARIS, utilizada para suportar atividades comerciais.
Ao utilizar a aplicação ARIS, todas as atividades serão registadas permanentemente e estarão disponíveis para o utilizador como documentação, algo a que os responsáveis pelo tratamento também terão acesso.
Os responsáveis pelo tratamento irão tratar as seguintes categorias de dados pessoais: nome, contacto do utilizado, nome/denominação do cliente, bem como dados analíticos (a saber: dados de cliques gerados durante o uso, por exemplo, arquivos em PDF, apresentações em PowerPoint ou tabelas de Excel, ficheiros de vídeo ou áudio, etc.
A Silhouette International AG fará o upload e irá administrar o conteúdo da aplicação ARIS.

Os dados pessoais serão tratados quando tal seja necessário para a execução de um contrato, e para prossecução dos interesses legítimos da Silhouette International AG e do Grupo Brodheim, no que respeita planeamento de vendas e gestão global das atividades comerciais.

Os dados pessoais serão transferidos para a Pitcher AG, bem como para a SALESFORCE.COM, INC., responsáveis pela operação dos sistemas de TI e hosting, e que asseguram a segurança dos sistemas de TI, para consultores fiscais, auditores, advogados contratados pelos responsáveis pelo tratamento, autoridades fiscais ou outras autoridades públicas, bem como empresas dos respetivos grupos.

Destinatários em países fora da UE ou organizações internacionais

A SALESFORCE.COM (e suas afiliadas) têm parte das suas sedes fora da União Europeia, sendo a transferência de dados feita com base em Cláusulas Contratuais Gerais, EU-US Privacy-Shield, bem como Regras Corporativas Vinculativas aplicáveis a todo o grupo SALESFORCE.

Período de retenção de dados pessoais

Os dados são armazenados durante toda a sua atividade connosco. Quando esta termina, os dados são armazenados por um período de sete anos, para efeitos de cumprimento das obrigações legais de retenção, em formato personalizado (este período será de dez anos no caso português). O prazo inicia com o encerramento do exercício fiscal em que o contrato de trabalho foi terminado e quando todas as suas reivindicações tiverem sido atendidas.

Direitos dos titulares dos dados pessoais

• Direito de acesso - o titular dos dados tem o direito de obter do responsável pelo tratamento a confirmação de que os dados pessoais que lhe digam respeito são ou não objeto de tratamento, e, sendo este o caso, o direito de aceder aos seus dados pessoais e a informações tais como a finalidade do tratamento, as categorias de dados pessoais em questão, entre outras.
• Direito de retificação - o titular tem o direito de obter, sem demora injustificada, do responsável pelo tratamento a retificação dos dados pessoais inexatos que lhe digam respeito.
• Direito ao apagamento - o titular tem o direito de obter do responsável pelo tratamento o apagamento dos seus dados pessoais, sem demora injustificada, quando se aplique um dos seguintes motivos:
o Os dados pessoais deixaram de ser necessários para a finalidade que motivou a sua recolha ou tratamento;
o O titular opõe-se ao tratamento, e não existem interesses legítimos prevalecentes que justifiquem o tratamento;
o O titular retira o seu consentimento relativo ao tratamento (quando este é o fundamento de licitude), e quando não há outro fundamento de licitude que sustente a operação de tratamento.
• Direito à limitação do tratamento - o titular tem o direito de obter do responsável pelo tratamento a limitação do tratamento, se se aplicar uma das seguintes situações:
o Contestar a exatidão dos dados pessoais, durante um período que permita aos responsáveis pelo tratamento verificar a sua exatidão;
o O tratamento for ilícito e o titular dos dados se opuser ao apagamento dos dados pessoais e solicitar, em contrapartida, a limitação da sua utilização;
o Os responsáveis pelo tratamento já não precisarem dos dados pessoais para fins de tratamento, mas esses dados sejam requeridos pelo titular para efeitos de declaração, exercício ou defesa de um direito num processo judicial;
o Se o titular se tiver oposto ao tratamento, até se verificar que os motivos legítimos do responsável pelo tratamento prevalecem sobre os do titular dos dados.
• Direito de oposição - o titular dos dados tem o direito de se opor a qualquer momento, por motivos relacionados com a sua situação particular, ao tratamento dos dados pessoais que lhe digam respeito, nos casos em que os seus dados sejam tratados com base no interesse legítimo dos responsáveis pelo tratamento, quando sejam tratados para propósitos de marketing, ou quando o tratamento inclua definição de perfis.
• Possibilidade de transferência de dados - o titular dos dados tem o direito de receber os dados pessoais que lhe digam respeito e que tenha fornecido a um responsável pelo tratamento, num formato estruturado, de uso corrente e de leitura automática, e o direito de transmitir esses dados a outro responsável pelo tratamento sem que o responsável a quem os dados pessoais foram fornecidos o possa impedir, quando o tratamento foi baseado no consentimento, ou realizado por meios automatizados.
